News organizations hit speedbump in efforts to obtain affidavit used in Gizmodo search warrant

Earlier this week, a number of news organizations filed a motion asking a Judge to unseal the affidavit used in the search warrant on Gizmodo editor Jason Chen’s home. A hearing on the motion went down yesterday afternoon and it was swiftly rejected by the Judge Stephen Hall of the Superior Court in San Mateo County.

The story may not be over just quite yet though. Hall, who refused to hear the motion, decided to defer the case to the judge who actually issued the controversial warrant in the first place. As expected, the district attorney’s office involved in the matter opposed the motion, arguing in their legal brief that prosecutors have a right to “maintain the security of an ongoing investigation, which may well be compromised by the disclosure of the search warrant affidavit.”
