Vivid, purveyor of adult films, claims the HTC Vivid violates their trademark

HTC will soon release its latest handset in a long string of products meant to take on the iPhone and compete with the best of whatever other Android manufacturers have to offer. Dubbed the HTC Vivid, the latest smartphone from HTC is 4G compatible, sports a 4.3-inch screen, and includes some high-end specs to boot.

But the most interesting thing about the HTC Vivid has nothing to do with its 8 megapixel camera or ability to shoot HD video. Rather, the most interesting thing about the HTC Vivid is the name of the device itself.

You see, Vivid might already sound familiar on account of the Vivid Entertainment Group, a company specializing in adult video production. With a focus on Hollywood quality production and contracts that tie up some of the hottest females in the industry to exclusive contracts, Vivid over the past two decades steadily became one of the more successful and well-known adult studios in the US.

And even assuming you haven’t heard of Vivid, there’s more than a good chance that you’ve seen or at least heard of their work. That’s to say that Vivid is the company that put out sex tapes from the likes of Pamela Anderson and Kim Kardashian.

That all said, Vivid sent a cease and desist letter to HTC alleging that their latest smartphone model – the HTC Vivid – infringes upon their trademark. HTC has until November 21 to change the name or else Vivid is going to sue.

Responding to the allegations, an HTC spokesman said, “We are reviewing the complaint and don’t expect to have any further comment until it is resolved.”

Regarding the potential lawsuit itself, Vivid claims that the smartphone will lead to brand confusion. While that might, at first, seem like far fetched notion, that high-res 4.5 inch screen was seemingly built for..

I kid I kid. In all seriousness, Vivid believe it or not actually launched its own Google TV channel earlier this month so maybe there’s something, however tiny, to Vivid’s allegations. But when push comes to shove, we just can’t envision anyone picking up an HTC Vivid and thinking it has anything to do with an adult movie studio.
